HANABABY ADVENTURE WORLD PARTICIPANT WAIVER, RELEASE, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT
This Waiver, Release, Assumption of Risk, and Indemnification Agreement ("Release") is voluntarily executed by [Participant Name] ("Participant") on [Effective Date], in connection with the use of facilities at HANABABY ADVENTURE WORLD ("HANABABY").
**General Release:
I acknowledge and agree that this Release covers and releases HANABABY ADVENTURE WORLD, its agents, owners, officers, managers, shareholders, affiliates, volunteers, participants, employees, assigns, and all other individuals or entities acting on its behalf from any claims, demands, actions, or causes of action, whether known or unknown, arising from or related to my participation in activities at HANABABY.
**Release of Liability for Attractions:
I acknowledge and agree that participation in activities at HANABABY involves inherent risks, including but not limited to physical or emotional injury, paralysis, death, and damage to personal property. I voluntarily assume all such risks and agree to use HANABABY facilities responsibly.
**Voluntary Assumption of Risk:
I acknowledge and agree that participation is voluntary and at my own risk. I understand that injuries can result from the actions of other participants or HANABABY employees, and I release HANABABY from any liability for such injuries. The risks include choking incidents, caused by or resulting from using the sandbox facilities. Among other things and without limitation of the generality of the preceding: exposure of participants to the risk of cuts and bruises, sprained or broken wrists and ankles, concussions, dislocations, head/neck injuries, and in some cases more serious injuries, including paralysis or death. Serious injuries to limbs might occur to children participating in various slides despite following proper instructions, as individuals have different body conditions. Physical harm might happen due to collisions while playing a variety of slides, inside the facility. Damages to the body can happen moving about inside the theme park, despite the safety precautions taken by our staff. During flu seasons, raised possibility of catching colds, flu, or other diseases from other participants should not be ignored. If you or your child is injured, you or your child may require medical assistance, at your own, sole expense.
**Agreement to Pay Medical Expenses:
I acknowledge and assume the risk of any medical conditions or limitations, known or unknown, that may contribute to injuries sustained while using HANABABY facilities. I agree to bear all costs associated with any medical assistance required.
**Photo/Video/Social Media Waiver:
I consent to the recording and use of my and/or my child's likeness, voice, and name in connection with HANABABY activities for promotional purposes, without compensation or approval rights.
**Parent or Guardian Consent:
As the Parent or Legal Guardian of the minor Participant, I agree to all terms of this Agreement on behalf of both myself and the minor Participant. I acknowledge that by signing this, I waive certain legal rights and agree to indemnify HANABABY ADVENTURE WORLD for any claims arising from the minor's participation.
**Parent or Guardian Indemnification:
I agree to fully indemnify and hold harmless HANABABY ADVENTURE WORLD, its agents, owners, officers, managers, shareholders, affiliates, volunteers, participants, employees, assigns, and all other individuals or entities acting on its behalf from any claims arising from the minor Participant's use of HANABABY facilities or attractions.
**Supervision Responsibility for using the sandbox:
Participant agrees to supervise any child under their care at all times while using the sandbox facilities. It is the responsibility of the Participant to ensure that children do not ingest or choke on any sand or objects within the sandbox.
